The appeal has been filed against the ex -parte ad interim order passed by the
whole time member of the Securities and Exchange Boar d of India (the Board) on
December 28, 2011 whereby the appellant, alongwith some other entities, was
prohibited from taking up any new assignmen t or involvement in any new issue of
capital including IPO, follow on issue etc. from the securities market in any manner
whatsoever from the date of the order till further directions. The said order was also
treated as show cause notice to the appellant.

  1. The grievance of the appellant is that inspite of its reply to the show cause notice
    and later personal hearing on May 7, 2012, the Board has failed to pass any final order
    and the appellant is being deprived of carrying out its business activities. The appellant,
    therefore, prays that the impugned order be set aside. 2
  2. Learned counsel for the Board has pla ced on record an order dated
    September 11, 2012 which has been passed by the Board after considering the reply
    filed by the appellant. By the said order the direction issued by the Board in its ex-parte
    ad interim order dated December 28, 2011 against the appellant has been confirmed.
    Since the Board has already passed the conf irmatory order, as stated above, the
    appeal against the ex-parte ad interim order has become infructuous.

The miscellaneous application as well as the appeal are dismissed as
infructuous.
