1. There is a delay of 27 days in filing the appeal. For

the reasons stated in the application, the delay in filing the appeal is condoned. Misc. Application no.467 of 2020 is allowed.

2. We have heard Mr. Alok Tiwari, Advocate assisted

by Ms. Dakshayani Saxena, Ms. Neha Sonawane, Ms. Dhwani Shah, Advocates and Mr. Ravindra Kumar Sharma, Authorised Representative for the Appellant and Mr. Kevic Setalvad, Senior Advocate assisted by Mr. Mihir Mody, Mr. Arnav Misra and Mr. Shehaab Roshan, Advocates for the Respondent.

3. Two weeks time is allowed to the respondent to file

reply. A week thereafter to the appellant to file rejoinder. The matter would be listed on 24th December, 2020 alongwith Appeal nos.399, 400 and 407 of 2020.

4. In the meanwhile, if the appellant deposits a sum of

Rs.10 lakhs within three weeks from today the balance amount shall not be recovered during the pendency of the appeal.

5. Parties are directed to contact the Registrar 48 hours

before the date fixed to find out as to whether the hearing would take place through video conferencing or through physical hearing.

6. The present matter was heard through video

conference due to Covid-19 pandemic. At this stage it is not possible to sign a copy of this order nor a certified copy of this order could be issued by the registry.
