1. The controversy involved in the present appeal is

squarely covered by the decision of this Tribunal in Chokhani International Limited vs. BSE Limited in Appeal no.348 of 2018 decided on 7th August, 2019.

2. For the reasons stated in the said decision, in the

instant case we find that after the issuance of the show cause notice, no opportunity of personal hearing was provided to the appellant. Consequently, the impugned order is violative of the principles of natural justice as embodied under Article 14 of the Constitution of India.

3. For the reasons stated aforesaid, the impugned order

cannot be sustained and is quashed. The appeal is allowed. The respondent is directed to proceed from the stage of issuance of the show cause notice.
